Nestlé respects your right to online privacy when you use our digital apps, websites, and/or contact us electronically. We take all the necessary steps to safely store any personal and/or sensitive information that you may provide to us. 

This Privacy Policy establishes the data processing practices of Nestlé Perú on the internet and any other electronic communications network.  

It is extremely important to take into account that, in Peru, Nestlé Perú S.A. is firstly and foremost responsible for the processing (please see question 18 in this notice) of your personal data. The principles established in this Privacy Notice apply to all parties responsible for data processing in the Nestlé Family of Companies.

In this document, we ask ourselves a series of key questions regarding the personal data you provided to Nestlé Perú, questions whose answers we believe will be of interest to you. This way, you can inform yourself about your rights in regard to personal data and the steps that Nestlé Perú takes to ensure the privacy and security of your personal data. We hope you find all of this information useful.

1. What personal data does Nestlé collect in this app and/or website, how does it obtain it, and what is the purpose of collecting and processing the personal data you provide to us?

We only collect the personal data that YOU wish to provide us with, or the personal data necessary to provide you with (and improve) our services. We collect direct personal data such as full names, identity document numbers, contact telephone/cellphone numbers, home address, and email address, as well as indirect information such as cookies (information on user preferences when you visit an app), links, and system information.

The purpose of collecting and processing the personal data you provide to is to provide you with information on Nestlé Perú products and companies, as well as information from the websites of said companies at Nestlé Perú so you can take part in our contests, promotions, discounts, drawings, registrations or surveys; to provide you with marketing and/or advertising information; to communicate using the personal data provided to request the validation and/or updating of your information; to communicate with you to provide you with information regarding your interest in forming part of the Nestlé Talent Network/ads for available job positions; answer your complaints, questions, and suggestions regarding our products, services, or any business unit or new developments at Nestlé, including job openings that may interest you.

The collected data that you provide to us will be stored in the “Clients” Database, identified by Code RNPDP-PJP-N°889, or in our “Human Resources” Database, identified by Code RNPDP-PJP-N°894, of which Nestlé Perú S.A. is the owner, as applicable. 

The authorization you grant us upon providing your personal data is compulsory in order to fulfill the purposes described in this document. Remember that by providing us with your personal data, you are authorizing us to contact you through the indicated means  (WhatsApp calls or messages to your contact number, email address, direct messages on social media, mailings).

You can rest assured that Nestlé Perú takes all necessary steps to keep any data you may send us private and secure.

All Nestlé personnel who have access to your personal data are required to follow the Privacy Policy of the Nestlé Family of Companies, Nestlé Perú S.A., and all personal data protection laws in force. The employees of Third Parties with access to your personal data have also signed nondisclosure agreements under the terms established in the laws in force. Our contracts with third-party companies that have access to your personal data also ensure that they will store it securely. To guarantee that your personal data is protected, Nestlé has an IT security environment and takes all necessary steps to prevent unauthorized access (e.g., via hacking).

3. What does Nestlé use your personal data for?

Your personal data will be used for the purpose for which you provided it to Nestlé. It will also be used to manage, support, and obtain information on the quality of our services and to prevent instances of noncompliance in matters of security, legal issues, and our contractual commitments, as well as those purposes indicated in question 1 above. 

 

4. Who in the Nestlé Family of Companies has access to your personal data and why?

Nestlé will never share your personal data with any Third-Party commercial organization that seeks to use it in its direct marketing activities, unless you have expressly authorized us to do so.

To learn about Nestlé’s policy on: (i) direct email marketing; (ii) your right to ask Nestlé, at any time, NOT to contact you through direct email marketing; and (iii) your right to erase your personal data from our systems, please see questions 9 and 6, respectively.

Nestlé Perú may share your personal data with other Nestlé companies worldwide only as necessary to achieve the purpose for which you provided it to us. 

Nestlé can also share your personal data with the Third Parties indicated in question 2, but only under circumstances strictly limited to achieving the purposes set forth in question 1. 

 

5. Cross-Border Flow of Your Personal Data 

Given that our main internet service provider is Acquia Inc, located at 53 State Street Boston, MA 02109, United States of America, we hereby inform you that we perform the cross-border flow of said data, which is reported to the relevant authority.

We guarantee you that our provider maintains, at all times, the same security levels as Nestlé Perú in regard to your personal data, and, when necessary, our provider is bound by legal commitments to store your personal data privately and safely, and to use it exclusively following specific instructions from Nestlé Perú.

We can also provide your personal data to administrative bodies and the competent authorities in the following cases: If we are required to do so in accordance with the provisions of any applicable law; or if, acting in good faith, we believe such action is reasonably necessary to comply with a judicial proceeding, to respond to any claim or legal demand, or to protect the rights of Nestlé Family of Companies or its clients and the general public.

 

6. How can you view, verify, change, or delete the personal data you send us?

You can delete, correct, or review your personal data by sending an email to [email protected], or sending a letter to Nestlé Perú, Calle Luis Galvani 493, Urbanización Industrial Santa Rosa, Ate Vitarte. 

In compliance with the Personal Data Act and its regulations currently in force in Peru, we offer you a description of the Procedure for exercising your “ARCO” rights:

To exercise the rights of access, rectification, cancellation, and opposition – hereinafter, the “ARCO Rights” – within the framework of Law 29733 - the Personal Data Protection Act (hereinafter, the “Act”) and its Regulations approved by Executive Order (Decreto Supremo) 003-2013-JUS (hereinafter, the “Regulations”), the rights of all persons that can be exercised toward NESTLÉ PERÚ S.A. with regard to the processing of their personal data are as follows:

  • Right to access: To obtain the information about you that is processed in databanks owned by NESTLÉ PERÚ S.A., the way in which your data was collected, the reasons for its collection, and at whose request the collection was performed, as well as any performed or planned transfers of this data.
  • Right to rectification (updating and inclusion): To modify any data that is partially or wholly inaccurate, incomplete, erroneous, or false.
  • Right to cancellation (deletion): To request the deletion or cancellation of your personal data from a personal databank, when it has ceased to be necessary or relevant for the purpose for which it was collected; the deadline for its processing has passed; your consent to processing has been revoked; and in all other cases in which such data is not being processed in accordance with the Act and the Regulations.
  • Right to opposition: To check and verify that the processing of the Owner’s personal data falls under the purposes for which his or her consent was granted to NESTLÉ PERÚ S.A.

Personal data “ARCO” Rights can only be exercised by the Owner of the Personal Data, without prejudice to the laws regulating the representation thereof.

The request to exercise “ARCO” Rights shall be made by:
Sending a physical “Request to Exercise ARCO Rights” to Calle Luis Galvani 493, District of Ate, Province and Department of Lima, or via email at [email protected].

The request to exercise “ARCO” Rights shall be addressed to the parties responsible for Personal Data Protection at NESTLÉ PERÚ S.A., who will verify that the request contains the following required information: 

  • The full name of the Owner of the Personal Data.
  • National Identity Document (DNI), passport, or equivalent document of the Owner of the Personal Data, which must be exhibited upon submitting the request to prove his or her identity, attaching a copy thereof. In case the Owner is acting by proxy, the request shall indicate the name and National Identity Document (DNI) or equivalent document of the representative of the Owner of the Personal Date, attaching a copy thereof, along with a copy of the National Identity Document (DNI) or equivalent document of the party represented, as well as the document containing the representative’s power of attorney with express powers to exercise the respective ARCO Right (Power of Attorney with Notarized Signature).
  • Address or email address, for notification purposes.
  • Petition in which the request is made, indicating the right being exercised by Owner of the Personal Data.
  • In case of requests for rectification (updating, inclusion) of personal data, the requesting party must indicate which personal data he or she is referring to, as well as the modifications to be made to it, providing the relevant documentation  in support of his or her petition.

The request may contain any additional elements or documents that help locate the requested personal data, as well as information on other means of contact, such as telephone numbers, that aid in processing the request to exercise ARCO Rights.

  • When seeking to access databanks of recorded images, a recent photograph will be required.
  • Date and requesting party’s signature.

With regard to the receipt and correction of the request for the exercise of rights, we hereby inform you that all requests submitted shall be received by NESTLÉ PERÚ S.A., placing on record the receipt thereof using the same formality through which it was submitted. If the request does not meet the necessary requirements, NESTLÉ PERÚ S.A., within a term of five (5) days counted from the day following the receipt of the request, shall note any objections due to noncompliance that cannot be rectified ex officio, inviting the Owner of the Personal Data to rectify them within a term not to exceed five (5) days. If this period transpires and the rectification has not been made, the request will be considered not to have been submitted. If the information provided in the request is insufficient or erroneous, such that it cannot be responded to, NESTLÉ may solicit, within seven (7) days following receipt of the request, additional information from the Owner of the Personal Data to process it. Within a term of ten (10) days following receipt of the request, counted as from the day following the receipt thereof, the Owner of Personal Data shall provide the additional documentation he or she deems relevant as grounds for his or her request. Otherwise, the request will be considered not to have been submitted.

NESTLÉ PERÚ S.A. shall have a maximum term of twenty (20) days to respond to a request for the exercise of the right to access, counted as from the day following the submission of the request by the Owner of Personal Information or the rectification thereof. If the request is admitted and NESTLÉ PERÚ S.A. does not include the requested information with its reply, access shall be effectively granted within ten (10) days following said reply. In case of the exercise of the right to rectification, the maximum term for NESTLÉ PERÚ S.A. to reply shall be ten (10) days, counted as from the day following the submission of the corresponding request, or the rectification or supplementation thereof with additional information, as applicable. The deadlines for the reply or the allowance of the exercise of the rights in question may be extended for one time only, for an equal term, at most, provided that the circumstances so justify. The justification for the extension of the deadline shall be notified to the Owner of the Personal Data by the deadline to be extended.

NESTLÉ PERÚ S.A. will deny the request to exercise rights submitted by the Owner of the Personal Data in the following cases:

  • If the requesting party is not the Owner of the Personal Data or a legal representative properly accredited for such purpose.
  • If the requesting party’s personal data are not found in the Databanks of NESTLÉ PERÚ S.A. 
  • If there is a legal impediment, or a judicial or administrative ruling that restricts the exercise of the ARCO Rights by the Owner thereof.
  • When the Owner of the Personal Data has already exercised one of his or her ARCO Rights and seeks to do so again before the deadline by which NESTLÉ PERÚ S.A. is required to respond to his or her request.  

 

7. What countries will your personal data be sent to and why?

Nestlé is a global company and it is possible that your data may be transferred internationally. It may be transferred to countries with data protection legislation of a different level than that in force in the country in which you provided your personal data. It is also possible that this data may be transferred among different companies of the Nestlé Family of Companies located in different countries. In light of the foregoing, Nestlé Perú takes appropriate steps to maintain the personal data security level for the duration of the transfer and in the location where the personal data is received.

The server that enables this applicable may be located outside the country from which you are accessing this page. Our main internet service provider for most Nestlé applications is Acquia Inc, located at 53 State Street Boston, MA 02109, United States of America. This provider has a contractual commitment to guarantee a high level of privacy protection that requires it (among other obligations) to act exclusively according to the instructions of Nestlé and to regularly implement all necessary technical measures to securely store your personal data.

 

8. Cookies (Tracking Technology): How and why does Nestlé use them?

Nestlé uses tracking technology (“Cookies”) to collect personal data such as the operating system and web browser, referring page, pathway within the application, ISP domain, etc., in order to learn about the use that visitors make of this page. Cookies help us tailor this application to your needs.

Nestlé stores all information collected through cookies in a non-personally identifiable format. Access to the information obtained through cookies is not possible outside of the Nestlé Family of Companies or authorized Third Parties. This information will not be used for unsolicited contact.

Cookies located on your computer do not contain your name, only an IP address. After the user session has been erased, the information contained in the cookies ceases to be available to Nestlé.

Please check to make sure your computer’s settings reflect whether or not you wish to accept cookies. You can configure your browser to notify you before accepting cookies, or you can set it to reject them always, although in this case you will not be able to access all of the functionalities of this application. Use the “Help” button in your browser to learn how to do all of this. You do not need to have cookies activated to use or surf many parts of this and other Nestlé applications. Remember that if you use different computers in different locations, you will need to make sure that each browser is set according to your preferences regarding cookies.

 

9. Electronic Marketing: What is spam and what is Nestlé’s position with regard to spam emails?

The term “spam” refers to unsolicited emails sent without your authorization containing advertising or marketing materials. Nestlé obeys the laws in force, and thus DOES NOT send spam emails. Nestlé uses an anti-SPAM tool to protect our employees from spam emails. Sending unauthorized emails is illegal in many countries. Nestlé will not use your personal data (including your email address) for direct marketing actions or follow-up communications, unless you EXPRESSLY authorize us to do so. This is known as an “OPT-IN” authorization.

Likewise, Nestlé will not share your personal data with Third Parties that intend to use your information for spam emails.

Nestlé applications offer you the chance to receive marketing information by email. Each email sent by Nestlé gives you the opportunity, at any time, to stop receiving emails with marketing content.

If, for any reason, you believe you have received spam email from a company from the Nestlé Family of Companies, please contact us immediately at the address indicated above. For details on the address, please see question 5: “How can you view, verify, change, or delete the personal data you send us?”

 

10. How long does Nestlé keep your personal data?

Nestlé will keep the personal data you provide to us for ten years or until you expressly ask us to delete it, in accordance with your ARCO rights, whichever happens first. After this time, your personal data will be deleted from all of Nestlé Perú’s systems.
Remember that you have the right to delete your personal data at any time. Please see question 6: “How can you view, verify, change, or delete the personal data you send us?”

 

11. Does Nestlé communicate with Third-Party applications? If so, what happens to my personal data when that link occurs?

Nestlé links to other applications to give you the chance to check out interesting information pertaining to Nestlé. These Third-Party applications fall outside of our control and are not covered by the contents of this Privacy Notice. If you access other applications using the links provided, the operators of these applications may collect your personal data. Please make sure you are in agreement with the Privacy Policies of these Third-Party applications before providing any type of personal information. Nestlé tries to do everything within its control to guarantee that all Third-Party applications to which it provides links use equivalent personal data protection measures, but we cannot be held responsible, whether legally or otherwise, for the activities, privacy policies, or degree of compliance with privacy commitments by Third Parties.

 

12. What happens to my personal data when a send a Nestlé application by email to another person?

Some of our applications may give you the possibility of sending the address of an application to another person by email. In order for this option to work, we will need your email address and/or the email addresses of the persons to whom you wish to send the application. The email addresses collected in this way are not used for any purpose other than fulfilling your request. These email addresses are not stored; they are immediately deleted after fulfilling your request.

 

13. What happens to my personal data if I participate in a Nestlé survey through this application?

From time to time, we may ask visitors to our applications to any survey questions. In general, these surveys are related to the content of the application itself, or to our products or product categories. We may ask about an age or age range, sex, and/or other non-personally identifiable information. For the purpose of these surveys, we may add information obtained from cookies to your survey responses, but you will not be asked for any personally identifiable information. The personal data collected are not linked to any other type of personal information with which you may have already provided us. The personal data obtained through polls and surveys are exclusively for internal use by Nestlé, but the aggregate information (which is not susceptible to personal identification) may be shared with third parties.

 

14. What is one-time registration?

To facilitate the registration process, we use a single sign-on tool for many Nestlé applications. With this tool, when you sign in to our application, this information can be automatically made available for you to sign into other Nestlé applications. Your personal data remains protected, and we always ask for your express authorization (“Opt-In”) to receive information from Nestlé applications before you are included on a mailing list.

 

15. Can Nestlé change the terms of this Privacy Notice?

Occasionally, Nestlé may make changes and corrections to this Privacy Notice. Please check this notice regularly to consult any changes that may have been made and how they may affect you.

 

16. Where can I find more information on legal matters regarding Nestlé applications and my legal rights and obligations?

Because Nestlé is a company with affiliates in many countries, the applicable laws governing this application are those in force in the country where you reside. For more detailed information, please check the Legal Notice that you can find in this same application.

18. Which terms have a specific legal meaning in this Nestlé Privacy Notice?

(For greater ease of use, these terms are denoted by a capital first letter, except the terms “personal information” or “personal data,” since they repeat so frequently.)

“Personal information” or “personal data” refer to any information pertaining to you as a physical individual that may make it possible to identify you, whether directly or indirectly (in applications, these terms typically refer, at a minimum, to your email address).

“Personal data processing” refers to any operation or set of operations performed with your personal data, whether or not through automated means, including data collection, registration, organization, storage, adaptation or modification, recovery, consultation, use, access via transmission, dissemination or other forms of availability, alignment or combination, lockout, erasure or destruction (e.g., any activity that Nestlé effectively performs in relation to the personal data you send us).

“Party responsible for data processing” is the sole or combined organization that determines the objectives and the means for the Processing of your personal data (e.g., the Nestlé entity that operates this application and collects your personal data). In the present case, this means Nestlé Perú S.A.

“Third Parties” refers, for the purposes of this Privacy Notice, to any company that is not under the control of Nestlé S.A. through direct or indirect ownership.

“Nestlé” and “Nestlé Family of Companies,” in this Privacy Notice, both refer to Nestlé S.A. and its branches and affiliates (over which Nestlé S.A. has control through direct or indirect ownership), and are used in the appropriate form depending on context.

 

19. IMPORTANT: Why do I have to agree to the terms of this Privacy Notice?

This Privacy Notice gives you all the information you need (in an easily accessible way) to make an informed decision regarding whether to use this application to send your personal data to Nestlé. 

Thus, by navigating around this application and communicating electronically with us, you recognize and agree to the Processing of your indirect personal data (cookies, connection, and system information), as set forth in this Privacy Notice.

If you ask us to provide you with a given service (e.g., to participate in a contest, receive publications, or obtain information on new products, etc.), we will need you to provide us with some direct personal data (name, address, and email). In this case, we will ask for your express authorization to collect and use this personal data. This personal information will only be used for the purposes for which you have provided it.
